General Terms and Conditions of Sale
Article 1 – Purpose
These General Terms and Conditions of Sale (GTCS) apply to all sales of goods made by the brand SP CUSTOM, owned by the company FLORIN INDUSTRIES, registered in the Nîmes Trade and Companies Register under number 98507208100013, with its head office located at 1 Impasse du 1er Mai 30410 Molières sur Cèze. These terms of sale aim to define the contractual relations between the company, hereinafter referred to as "SP CUSTOM," and any natural or legal person validating an order on the website www.sp-custom.com, hereinafter referred to as "the buyer."
Article 2 – Offers and Prices
The products are valid within the limits of available stock. The prices of the products are indicated in euros (€) including all taxes (VAT), excluding delivery charges. SP CUSTOM reserves the right to modify its prices at any time, but the products will be invoiced based on the rates in effect at the time of order confirmation.
Article 3 – Products
The products offered for sale are all the products available on this website. The essential characteristics of the products are presented on the SP CUSTOM website. The photographs and descriptions of the products are as accurate as possible but do not engage SP CUSTOM in any way.
Article 4 – Orders
Any order implies unreserved acceptance of these GTCS. Confirmation of the order constitutes acceptance of the GTCS and forms the contract. SP CUSTOM reserves the right to cancel or refuse any order without reason or particular compensation.
Article 5 – Delivery Times
Delivery times are indicative and may vary depending on product availability. In case of delivery delay, the buyer may cancel the order in writing, unless the delivery has occurred in the meantime.
Article 6 – Retention of Title
SP CUSTOM retains ownership of the products sold until full payment of the principal and ancillary price. In this regard, if the buyer is subject to judicial reorganization or liquidation, SP CUSTOM reserves the right to claim, within the collective proceedings, the products sold and remaining unpaid.
Article 7 – Payments
Payment for the products must be made in full on the day of the order by credit card or any other payment method offered on the site. In case of payment by check or bank transfer, the order will only be processed upon receipt of the payment.
Article 8 – Withdrawal and After-Sales Service
8.1 - Right of Withdrawal
In accordance with legal provisions, the buyer has a withdrawal period of 14 days from the receipt of the product to exercise their right of withdrawal, without having to justify reasons or pay penalties, except for return shipping costs. The product must be returned in its original condition and complete (packaging, accessories, instructions). The buyer will be fully refunded by the same method used for the payment of the relevant order.
8.2 - After-Sales Service
In case of a breakdown or malfunction of the product, upon presentation of the invoice, the buyer can choose between the following options:
- Full Refund: The buyer will be refunded the full purchase price of the product, including initial shipping costs. This option is only available within 30 days of receiving the product.
- Repair: The company will take charge of repairing the defective product as soon as possible.
- Replacement: The defective product will be replaced with an identical or equivalent product, subject to availability. To return a defective product, the customer must contact SP CUSTOM's customer service and follow the indicated procedure. Return shipping costs will be covered by SP CUSTOM in the case of a defective product.
Article 9 – Deliveries
The products will be delivered to the delivery address indicated by the buyer at the time of the order. Delivery times are indicative and may vary depending on product availability. In case of delivery delay, the buyer may cancel the order in writing, unless the delivery has occurred in the meantime.
Article 10 – Warranty
The products benefit from the legal guarantee of conformity and the legal guarantee against hidden defects. In case of non-conformity of a sold product, it can be returned to the company, which will take it back, exchange it, or refund it. All claims, exchange requests, or refunds must be made in writing within 30 days following delivery. The products benefit from a lifetime warranty on the proper functioning of the system. A defective product can be taken care of for repair by SP CUSTOM free of charge, upon presentation of the purchase invoice and provided that SP CUSTOM's responsibility is clear and that the product has not been damaged by a third party. The return must be made after contacting SP CUSTOM's customer service and following the indicated procedure.
Article 11 – Liability
SP CUSTOM cannot be held responsible for any material, immaterial, or physical damage that could result from the malfunction or misuse of the marketed products. SP CUSTOM's liability will, in any case, be limited to the amount of the order.
Article 12 – Intellectual Property
All elements of the website www.sp-custom.com are and remain the exclusive intellectual property of SP CUSTOM. No one is authorized to reproduce, exploit, redistribute, or use in any way, even partially, elements of the site, whether they are software, visual, or audio.
Article 13 – Law and Disputes
These GTCS are subject to French law. In case of dispute, the parties will seek an amicable solution before any legal action. Failing that, the dispute will be brought before the competent courts of Nîmes.
Article 14 – Personal Data
The personal data collected during the order are necessary for its management and are intended for SP CUSTOM. In accordance with the Data Protection Act and the General Data Protection Regulation (GDPR), the buyer has the following rights regarding their personal data:
- Right of Access: The buyer can request access to their personal data held by SP CUSTOM.
- Right of Rectification: The buyer can request the correction of their personal data if it is inaccurate or incomplete.
- Right to Erasure: The buyer can request the deletion of their personal data, subject to legal retention obligations.
- Right to Portability: The buyer can request to receive their personal data in a structured, commonly used, and machine-readable format, or to have it transferred to another data controller.
- Right to Object: The buyer can object to the processing of their personal data for legitimate reasons.
- Right to Restriction of Processing: The buyer can request the restriction of the processing of their personal data in certain circumstances.
SP CUSTOM is committed to implementing appropriate technical and organizational measures to protect personal data against loss, destruction, alteration, unauthorized access, or disclosure. Personal data is kept for the duration necessary to achieve the purposes for which it was collected, in compliance with legal and regulatory obligations.
